1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Delvir LLC ("Delvir," "we," "our," or "us"), governing your access to and use of the VA Rating Calculator service available at this website (the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.

2. Description of Service

VA Rating Calculator is an informational tool that analyzes uploaded military medical records using artificial intelligence to identify potential service-connected disability claims and estimate VA disability rating ranges. The Service generates a report based on the content of submitted records and applicable criteria under 38 CFR Part 4.

The Service offers a free preview analysis and a paid full report delivered digitally upon payment of a one-time fee.

3. Not Legal or Medical Advice

The Service does not constitute legal advice, medical advice, or any professional advisory service. All content generated by the Service, including estimated disability ratings, diagnostic codes, and regulatory citations, is provided for informational and educational purposes only. Nothing in any report generated by the Service should be construed as a guarantee, promise, or representation of any VA rating outcome.

You should not rely solely on any report generated by the Service when making decisions about your VA disability claim. We strongly encourage you to consult a licensed attorney, VA-accredited claims agent, or Veterans Service Organization (VSO) representative before filing or appealing any VA claim.

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

All content, design, software, trademarks, and materials comprising the Service are the exclusive property of Delvir LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes only.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Service without Delvir's express prior written consent.

7. Payment and Refund Policy

The full report is available for a one-time payment of $49.95 USD, processed securely through Stripe. All sales are final. We do not offer refunds except where required by applicable law. By completing a purchase, you authorize Delvir to charge the applicable fee to your selected payment method.

Your paid report is generated and delivered digitally upon confirmation of payment. It is your responsibility to download your report promptly following payment, as access may be time-limited.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. DELVIR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

DELVIR MAKES NO WARRANTY THAT ANY ESTIMATED RATING, DIAGNOSTIC CODE, OR REGULATORY ANALYSIS CONTAINED IN ANY REPORT REFLECTS OR PREDICTS ANY ACTUAL VA RATING DECISION. VA RATING DECISIONS ARE MADE SOLELY BY THE U.S. DEPARTMENT OF VETERANS AFFAIRS AND ARE SUBJECT TO INDIVIDUAL EXAMINATION, EVIDENCE, AND ADJUDICATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELVIR LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY VA CLAIM OUTCOME, EVEN IF DELVIR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL DELVIR'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DELVIR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless Delvir LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any records or content you upload to the Service.

11. Third-Party Services

The Service integrates with third-party providers including Stripe (payment processing), Anthropic (AI analysis), and Upstash (temporary data storage). Your use of these integrations is subject to the respective third-party terms of service and privacy policies. Delvir is not responsible for the practices or content of any third-party service.

12. Modifications to the Service and Terms

Delvir reserves the right to modify, suspend, or discontinue the Service at any time without notice. We may also revise these Terms at any time by posting an updated version to this page. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Delvir LLC with respect to the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.
